Overlapping entitlement with pension age benefits

The rules relating to overlapping entitlement of pension age benefits and universal credit when mixed-age couples form and when a claimant reaches state pension age are set out in the Universal Credit (Transitional Provisions) Regulations 2014 (SI.No.1230/2014).

Overlapping entitlement to pension age benefits in first assessment period

Regulation 5 and 6 of SI.No.1230/2014 (as amended by regulation 6 of SI.No.655/2020)

Makes provision for overlapping entitlement to pension age benefits and universal credit in the first assessment period after a newly formed mixed-age couple’s entitlement begins and in the last assessment period when a claimant reaches state pension age.

In Northern Ireland, the Universal Credit (Transitional Provisions) Regulations (Northern Ireland) 2016 (SR.No.226/2016) (as amended by SR.No.119/2020) include provisions relating to run-ons of pension age benefits for newly formed mixed-age couples that are equivalent to those made in Great Britain.
